Notices of Illegal Content and Points of Contact (Digital Services Act)
DRAFT — to be reviewed by a lawyer before publication. Last updated: 2026-10-24
TutorHabitat hosts content that users upload (boards, materials, chat) in private lesson rooms and does not disseminate it to the public, so it is a hosting service but not an online platform under the EU Digital Services Act (Regulation 2022/2065, Art. 3(g)(iii) and (i)). The following applies:
- Single point of contact for authorities and users (Art. 11–12): DSA_EMAIL. Languages: English, Polish, Spanish, German, French, Ukrainian, Italian, Portuguese.
- Legal representative in the EU (Art. 13; also our GDPR Art. 27 representative): EU_REPRESENTATIVE, EU_REPRESENTATIVE_ADDRESS, EU_REPRESENTATIVE_EMAIL, EU_REPRESENTATIVE_PHONE — the operator's Polish sp. z o.o., mandated in writing, unpaid. It may be addressed in addition to us. The service is provided by SPÓŁKA GŁÓWNA, not by the representative.
- Reporting illegal content (Art. 16): write to DSA_EMAIL with (1) why you believe the content is illegal, (2) where it is — the exact link, or a description precise enough to find it, (3) your name and e-mail (optional for child sexual abuse material), (4) a statement that the report is made in good faith. We confirm receipt and inform you of our decision.
- Statement of reasons (Art. 17): if we remove content or restrict an account, we tell the affected user why and how to appeal.
- Review: reply to our decision e-mail within 6 months; a person reviews it (voluntary internal review).
IF micro or small enterprise under Recommendation 2003/361/EC is documented: "As a micro or small enterprise, we are exempt from the transparency reporting obligation of Art. 15(1) (Art. 15(2))." Otherwise publish an annual transparency report.
